Eviction
questions & answers
Question: I helped a friend out and let her stay with me but she isn't playing rent and she isn't on my lease. How do I evict her and what kind of notice do I need to give her? Can it be written?
Answer:
If a person is not on the lease or paying rent they would not be considered a tenant and not protected by the landlord/tenant act. You could ask them to leave and if they did not you could call the police and report it as a trespass. Alternatively you could provide a 5 day notice in writing and if they failed to depart file a Forcible Entry and Detainer proceeding in Justice Court.
For additional resources see the Arizona Residential Landlord and Tenant Act, additionally the Maricopa County Justice Courts website has a useful section on evictions.
