Eviction

questions & answers

Question: I was told by a few friends that during the summer months in Arizona, when your involved in an eviction, that when small children are involved the landlord is unable to evict the family when there is no resources to provide shelter. Is this correct?

Answer: While the Arizona Residential Landlord Tenant Act prohibits landlords from discriminating against tenants with children, it contains no provisions that prohibit the landlord from evicting someone during the summer months, even if they have children. Take a look at the Arizona Tenants’ Rights and Responsibilities Handbook available here for more information. You can also see our page here for more information on legal aid available in your area.
