Question: I received a letter from an attorneys office stating that the home I am renting has been forclosed on.  How long do I have before being evicted? How do I recoup my deposit if I do not withold rent?

Answer: President Obama recently signed the "Protecting Tenants in Foreclosure Act (S. 896,P.L. 11-22). This law requires, in the event of foreclosure, the new owner must allow a tenant with a lease to occupy the property until the end of the lease. There are three exceptions: 1)the lease can be terminated in 90 days if sold to a purchaser who will occupy the property, 2)the lease has fewer than 90 days remaining, or 3)the tenancy is month-to-month in which case there must be at least 90 days notice. The new law expires on 12/31/12.
