Question: The father of my baby whom I've beenwbeen withfwith forofor overaover a yeargyeargave me a phone when ImI movedimoved in with him. He stole it from me while II was asleep a couple days ago.. He will not give it back . Is this against the law

Answer: Under the Arizona Criminal Code, a person commits the crime of “theft” when he or she takes control of property that belongs to another person without that other person’s permission and with the intent to deprive that other person of their property (A.R.S. 13-1802(A)). Here in Arizona, theft of any property with a value of less than $1,000 is a class 1 misdemeanor. The answer to the question of whether or not a crime has taken place in this particular case will depend on whether (1) the phone was removed from your control; (2) the phone was yours at the time when it was taken; and (3) it was taken without your permission.
