Question: What do you get for possession of marijuana
Answer: Assuming this is mere possession, and not possession for sale, one may be charged with a class 6 felony or a class 1 misdemeanor, which is at the discretion of the charging officer or prosecutor's office. With regard to potential sentence, again this is assuming mere possession and no prior convictions for drug offenses or felonies, probation is mandatory under Prop 200 and the person would not face any jail time. In some instances the person may be eligible for diversion which is a drug education/counseling program that, when completed, would result in a dismissal of the charge.
