Question: I live in a 55+ community and have just married a younger wife under the age requirement. IThe home owner own the mobile home and pay lot fees every month for the property. The Mobile home assoc. is trying to evict my wife because of her age. Do I have any rights to prevent this or is there a required amount of time the park must give me before I have to leave.

Answer: A.R.S Title 33, Chapter 11 http://www.dfbls.az.gov/userfiles/files/MHP%20LTA_as%20of%20January%202012%20%283%29%281%29.pdf gives the Landlord (Park Owner/Operator) the right to establish rules for Tenants (Mobile Home Owners). Rules establishing minimum age requirements within a Mobile Home Park, are typically spelled out in lease agreements signed by the tenant, and therefore are within such Landlord rights. A tenant below the minimum age rule specified in the lease constitutes a Breach of the lease. Breach of any lease normally results in eviction, if the breach is not “cured”. Eviction process and time periods are then in accordance with the requirements of the written lease.
