Question: I was charged with drug paraphernalia methamphetamine and pi then sentenced to a year unsupervised probation now 2 months later they indicted me on possession of methamphetamine on the same charge ... Can they do this? How did they do this?
Answer: If your original plea agreement did not include a dismissal of any other charges, they can charge you for the meth. I believe they may not have had the laboratory results back yet at the time you entered the plea agreement. It would have been better to wait to see if they would have given you a combined plea offer. Take a close look at your plea and see if there was any provision to dismiss any other charges.
