Question: I was an independent contractor for a local company. First, can they require a person to give them 60 days notice prior to quitting? I did quit (didn't give 60 days). The owner is claiming that I still have paperwork and keys, which I have turned in everything, and she's withholding my last paycheck. Can she do that? Can I, as an independent contractor, file a wage claim?
Answer: An independent contractor agreement is controlled by the agreement between the business and the independent contractor. Any notice requirement or withholding of fees for services rendered are determined by the language in the independent contractor agreement. Independent contractors cannot file a wage claim. Employees file wage claims. Independent contractors file breach of contract claims in court.
