questions & answers

Question: I was just recently terminated from my last job. my question is for the last 3 years I haven't been getting overtime pay and just over a year ago they started the profit sharing program am I able to get back pay?

Answer: Generally, employees can attempt to reclaim back pay for overtime from employers under the federal Fair Labor Standards Act. If an employee believes that he or she is entitled to back pay for overtime, that employee should file a complaint with the federal Department of Labor. See http://www.dol.gov/dol/topic/wages/backpay.htm for more information. Regarding 401(k) or profit-sharing plans, an employee should consult the employer's handbook or contract for more information. For fact-specific information and advice, please consult an attorney experienced in labor and employment law.
