Family Medical Leave Act
questions & answers
Question: My brother who is 36 needs to enter rehab for alcoholism. He spoke w/his supervisor & she supports him. She contacted the District Mgr. & was told my brother has to quit his job if he wants to enter rehab. Isn't that against the law?
Answer:
The Family Medical Leave Act (FMLA) allows for a person to take unpaid leave for: medical illness, to take care of an ill family member, or for the adjustment of a new child. Substance abuse can be covered under the FMLA but there are very specific qualifications.
First you must determine if the FMLA applies to your work place, click here to see if your work is covered.
Then to see if your situation qualifies review the Code of Federal Regulations: 29 CFR 825.114.
