questions & answers

Question: My dad and my uncle owned my Grandparents old property my dad passed away suddenly. Now we need to sale the property, how do we get the title into just my Uncles name? The title is 1/2 1/2 by name. We are trying to avoid Probate due to the cost and little value the property holds.

Answer: A transfer of title to real property from one person to another should be recorded in the form of a deed submitted to the county recorder in the county in which the property is located. (The Maricopa County Recorder and Elections Department website is https://recorder.maricopa.gov/.) If you would like specific advice as to what sort of deed you should use, you should speak with a real estate attorney.
