Question: Me and my ex-spouse has joint custody, recently I move and have not reported to the court. Im scared to let him know my new residents due to the threats that I recieve by text and answering machine I decided to get a training order is there anything that I need to know addiction to this order?
Answer:
Notice of relocation may be required either by order of the court or by statute (see A.R.S. 25-408). However, if safety is a concern or there are issues of domestic violence that place the child in jeopardy, a parent may seek to modify the custody (Legal decision-making and parenting time) order. If a parent is receiving threats from the co parent then a protective order and modification of the custody order may be appropriate. Additionally, any evidence of threats (emails, text messages, etc.) should be preserved as they may be important in any court proceedings. The Arizona Supreme Court has two publications that may be helpful in this situation: Things You Should Know About Legal Decision-Making and Parenting Time, and Things You Should Know About Protective Orders.
