Question: I got a possession of marijuana charge, I wasn't arrested but forced to sign a fingerprint compliance form. The stuff wasn't mine, but it was close to me so I was blamed. It belonged to a friend that was there. If my friend and i go down to the police and explain the truth will my charge be removed and put on him?
Answer: An individual in a situation as this may wish to (1) have an independent drug test taken if you believe your test will be negative for drugs; (2) Have your friend write a statement indicating the drugs were his/hers; and (3) Speak with the prosecutor assigned to your case and provide the drug test (only if it is clean) and the statement from your friend. If your friend is willing to go with you, have him/her accompany you.
