Expunging or sealing records

questions & answers

Question: I was ticketed for criminal speeding when I was 17. Went to court and was told to do driving school to get rid of the charge. The charge hasn't been removed. The court clerk says that I was given the option for traffic school but doesn't know how to remove it. How would I remove it from my record? I feel it should be removed from the option of going to traffic school.

Answer: If you timely completed Defensive Driving School, the ticket should have been dismissed. That does not mean that the file is shredded and there is no record of you being ticketed in the first place. Arizona does not expunge records, and there will likely always be some kind of record of the civil traffic ticket. Now there should not be a record on your Motor Vehicle Record because you earned a dismissal which prevents it from being reported to the Motor Vehicle Division.
