Question: I was arrested in January of 2019 in Gila county, the preliminary hearing was vacated and I am not being charged but when a background check was done the charges were found. I am trying to re-enter military service, is there a way to make these go away since the state is not pressing charges and it’s been the better part of two years, what are my options?

Answer: Arizona law (ARS § 13-4051) states that “Any person who is wrongfully arrested, indicted or otherwise charged for any crime may petition the superior court for entry on all court records, police records and any other records of any other agency relating to such arrest or indictment a notation that the person has been cleared.” Contact the county superior court for information about petition requirements and instructions for how to file.
