Question: I understand the AZ definition of 'set aside a judgment of guilt' but I do not find details such as will I be able to get a HAZMAT endorsement for my CDL licence? Will I be able to work on the air force base when my employer sends me? Those types of details I cannot locate. Thank yo

Answer: It would depend on what you are requesting a set aside for. Normally DUI's or similar offenses (reckless driving, endangerment) are not set aside, however, if a judge does set it aside it does not eliminate how the MVD looks at it. The points and conviction will still be on your record. If it is another offense, again a set aside does not erase one's record, and there will be a record of a conviction, but then a set aside judgment order. Whether or not you will be able to get a Hazmat endorsement will depend on your qualification with MVD and their requirement. If you have a CDL presently, you probably are eligible and also probably do not have a DUI conviction. The military protocol will control whether or not you will be able to get on the base and if you pass their security clearance.
