questions & answers
Question: Can I file a claim on my former employer? They fired me because I am bipolar and I was off my medication and posted an opinion on a recent news event during a manic mood swing episode - that was totally unrelated to the company, the employees, the wages, or working conditions? If so, who do I contact?
Answer: A. The Americans with Disabilities Act as Amended (“ADAAA”) prohibits an employer from firing an employee with a disability, as defined by the ADAAA, if the employee can perform the essential functions of their job with or without reasonable accommodation. An employer may require a disabled employee to obey the same rules and meet the same performance standards that non-disabled employees must obey and meet. If you believe your employer had violated your ADAAA rights, you should contact the Equal Employment Opportunity Commission or the Arizona Civil Rights Division within 300 days of the last incident of discrimination. The contact information for the Equal Employment Opportunity Commission is: 3300 West Central Avenue, Suite 690 Phoenix, AZ 85012 Telephone:(602) 640-5000 or 1-(800) 669-4000 or TTY 1-(800) 669-6820 The contact information for the Arizona Attorney General Civil Rights Division is: 1275 W. Washington Street Phoenix, AZ 85007-2926 Telephone: (602) 542-5025 or 400 West Congress, Suite 315 Tucson, AZ 85701-1720 Telephone: (520) 628-6504 or 1000 Ainsworth Drive Suite A-210 Prescott, AZ 86305-1610 Telephone: (928) 778-1265
