Americans with Disabilities Act

questions & answers

Question: I am noticably disabled and live in a crime free.multi housing complex. There are several tenants who have either used a sharpie to change the expiration on their placards, have expired placards, or who simply park in the few disabled spots available. I have made the manager aware of these continual incidents, and was told that if they had any kind of placard or plate;(regardless of it's status), that the apartment management had no recourse. Is this accurate? If not, what can I do to see that this ADA accomadation is enforced properly?

Answer: Disability laws prevent people from asking a person driving a vehicle with disability plates or a disability placard about the person's disability. If a vehicle is parked in a designated disabled parking spot and the vehicle does not have disability plates or the designated placard or the plates or placard is expired, you should contact the local police department. The Arizona Motor Vehicle Division will also investigate complaints of disabled parking space abuse for any abuse, including placards that have been improperly altered. When calling the Motor Vehicle Division have the vehicle's license plate number and handicap placard number, if the vehicle has a placard. You can reach Arizona's Motor Vehicle Division at (602) 255-0072.
