Question: nhelp! my boyfriend was arrest ed on thrusday for inventing a fake social security and working under it but i ran the social and it does not belong to anyone in the u.s. so why are they hold ing him in jail. doesn't thatmean he is innocent. and can he get bond eve if he is an illegal immagrant?? please help.

Answer: Use of a fraudulent social security card to obtain employment or services is illegal, regardless if the social security number is fake. Bond may be denied to criminal defendant for many reasons, including risk of flight (i.e. a risk he will leave the country, or he will stay in the country, but won’t appear at trial). It is in the judge’s discretion to weigh the factors of the case and determine if bail should be granted or denied. In a document fraud case involving an illegal immigrant, the judge may be concerned about confirming the actual identity of the defendant and being able to locate the defendant if he does not appear at trial. If your boyfriend has an attorney, it would be best to address your concerns about bail to his attorney, as his attorney will have the specifics of your boyfriend’s case.
