Question: I just want to know if my boyfriend will get deported or what will happen to him. So in the past he got charged wit driving wit out lisence. & he had an arguiment wit his cousin outside n was being loud so da neighboor called da cops n they took him to goodyear police department then to 4th ave jail, I called & I got his next court is in 4 days & he does not have a bond. Most likely what will happen on his court date? He is an immagrant. Will he be deported?
Answer: The following information is provided for general information only. Immigration law is complex and fact-specific, so it is best to contact an attorney directly to find out how the law applies to a specific situation. It is hard to tell what will happen at a court date without knowing all the facts of the case. But, in the case of an undocumented immigrant, the police department may report the immigrant to ICE. ICE will decide whether or not to put a hold on the immigrant. An ICE hold means that the immigrant will not be released to the public once the State's criminal proceedings come to a close. Ask an attorney if there is a benefit to posting a bond to release the immigrant from county jail. If ICE placed a hold, the immigrant may NOT be released even if the bond is paid to release the immigrant from county jail. If ICE does place a hold, then the police department will transfer the undocumented immigrant from State custody into ICE federal custody after the criminal case has finished. Once in ICE custody, the immigrant will be placed in removal court proceedings. Removal proceedings are considered civil proceedings, so the immigrant or the immigrant's family has to hire an attorney if he/she wants legal representation. An immigration attorney can advise on whether or not the immigrant has a way to prevent the federal government from removing the undocumented immigrant to his/her home country. An immigration attorney can help fight for a bond. It is better to obtain and pay an immigration bond, because this gives the immigrant the opportunity to fight his/her case from home. If a bond cannot be obtained and paid, the immigrant will have to fight his/her case while detained in the immigration detention center.
