Immigration/Naturalization

questions & answers

Question: After 20 years we are looking to move back to the US from the UK. My wife has a British passport but had a green card when we lived in the US. We were looking to move over in September for the start of the school year but the Embassy in the UK is telling me that it will be 6 months before they even look at our I-130 petition, which I understand is only the start of the whole process. My parents are getting older and we want to be there to help them. Should we just come over and start the process (or reprocess) from the US for my wife's permanent/green card status?

Answer:

The following is provided for general information only. To find out how the law applies to a specific situation, contact an attorney directly.

We are unable to provide legal advice. The process for immigrating to the United States is a complicated and detailed process, especially following 9/11. You can find immigration information on the US Customs and Immigratio Service website. It would be prudent to contact an immigration attorney who can provide tailored legal advice in this situation.
