Question: my son died 10/22 he's never married and had no children. What form do I need to fill out to assume/satisfy his auto loan. The value is 22,998.00 with 17,200.00 still owing on the finance contract. He owned nothing else of any value. Will a notarized affidavit for collection of all personal property suffice and if so do I need to provide it to the court as well as the finance company? Thank you

Answer: The big question here is whether you actually want to assume his auto loan.  Unless you are a co-signer on the loan, you have no legal requirement to take on the loan.  You have the right to hand the car back and wash your hands of the whole thing.  If you want to keep the car and pay off the debt, you can use the affidavit for collection of personal property because the value is less than $75,000.  You can find the forms online in the Maricopa County Superior Court's website.  Go to: https://superiorcourt.maricopa.gov/llrc/court-forms/.
