Answer: The litigants decide on the division of assets from the marriage. If they are unable to agree, the court will decide or order them to mediate the issue. Arizona Revised Statute, Section 25-318 is the Arizona statute that governs the division of property when a marriage is dissolved. The courts prefer the parties come to an agreement on how to divide property and debit. The lawyer's purpose is to advise you and advocate for your position, not to make the decisions for you.
