Question: I am pregnant and not in a relationship with the father. He wanted me to get an abortion and I refused. He has provided no assistance or support and now that I am about to deliver he says he has a change of heart and is making unreasonable demands. What are my rights and how can I protect my child?

Answer:

A biological father who is not married to the biological mother at or near the time of conception will not automatically have any rights to a child. (A.R.S. 25-814) A biological father may gain rights to his child by voluntarily acknowledging paternity or by taking a paternity test. (A.R.S. 25-812)  Once rights are established the court will decide on issues of parenting time and child support.
