Question: My daughter's grandmother was granted visitation for 1 sunday a month, due to recent occurances, her father and i are wanting to go back to court and ask the judge to revoke her visitation rights. What do we need to file to get the correct hearing?
Answer: If you are a resident of Maricopa County, you can obtain the necessary forms on the Maricopa County Self Service website. The forms you need, located here, are petitions to modify an existing custody/visitation order. Pursuant to A.R.S. § 25-411, parties must wait one year after the decree order before requesting a modification unless there is reason to believe the child’s physical, mental, moral, or emotional health is in danger.
