Grandparents' Rights

questions & answers

Question: Hello my nephews and nieces are in dcs custody they won’t transfer the case over to California for the grandmother they are saying it can take up to 6 months is there a way she can file for temporary custody to get them out of dcs care in Arizona and placed with the paternal grandmother in California ?

Answer: If Arizona DCS has custody of the children, they are currently wards of the state.  If grandmother wants the children to live with her in California, she can reach out to Arizona DCS and talk with the case worker.  The normal procedure is for DCS to work with the agency in the state where grandmother lives, do a home study and evaluate her fitness and willingness to care for the children.  Once the home study is completed favorably, DCS will work with grandmother to put the children into her care.  The state's preference is always to have children live with a suitable relative if possible.
