Grandparents' Rights
questions & answers
Question: What is the process i need to take to get visitation with my grandson. What papers do i need to file? Do i need a lawyer?
Answer: In Arizona, the Superior Court may grant grandparents of a child reasonable visitation rights with the child, if it would be in the best interest of that child. Please refer to the Arizona Revised Statues for more information, specifically, ARS §25-409 which lists other requirements that must be met by the grandparents. Factors that the court will consider in determining what the best interest of the child is, can be found under ARS §25-409 Section C. Review this statute carefully, and then possibly consider consulting with a family law attorney for detailed legal advice.
