Question: Do my husband & I need to notify the parents of my husband's grandson, whom we've raised since 2003, that we wish to adopt him if the parents rights were temporarily terminated in 2000 and never restored? Mom's out of state & agreeable, dad is in prison where he's been most of the child's life.
Answer: You may want to review Title 8 of the Arizona Revised Statutes (A.R.S.), which contain the Arizona laws on adoption. A.R.S. § 8-106 discusses who must consent to the adoption in order for the court to grant an adoption. Some adoption forms and materials are available at the juvenile courts around the state. Other courts, such as Maricopa County, have information available online as well. Since adoption can be complicated and very fact specific, you may want to consult with an attorney.
