Guardianship of Minor

questions & answers

Question: My mom lives in a different county than myself and my daughter,I would like my mother to take temporary guardianship of my daughter for the purpose of enrolling her in school in the county that my mother lives in.Can she do that

Answer: You have two issues here: how to get/give temporary guardianship and whether it is proper to do so for education purposes.

Guardianship form/filing requirements depend on the county. This earlier question lists the laws around guardianship http://www.azlawhelp.org/viewquestions.cfm?sc=6&mc=1&qid=12664 and this link goes to the forms for Maricopa county https://www.superiorcourt.maricopa.gov/SuperiorCourt/Self-ServiceCenter/Forms/ProbateCases/prob_pbgct1.asp

Whether it is proper to do so for education is flexible. Temporary guardianship is only for 6 months and then you have to look at permanent. I don't know that courts will continue it as temporary multiple times. Also consider that guardianship has many more legal rights and responsibilities than schooling. You should carefully read the guardianship information and make sure you understand all the rights and responsibilities that go with it.
