Guardianship of Minor

questions & answers

Question: Our grandchildren have been placed with us by CPS. Is it still possible for us to file for guardianship? They have different fathers. One is amenable to the child staying with us but the other is contesting the placement.

Answer: The following is for information purposes only and should not be construed to be legal advice. Because guardianship can be very complicated, you may wish to consult an attorney directly. While grandparents can file for guardianship of a child, the ultimate determination will be made by the court according to what is in the child’s best interests. A.R.S. § 8-871 and § 8-872 give the laws on whom and how a person can obtain guardianship in the state of Arizona. One can find out more information on guardianship, the process for guardianship and the necessary forms through the local Superior Court. For Maricopa County, one can view the appropriate documents on the court's website.
