Guardianship of Minor
questions & answers
Question: How old does a child need to be to say where they would rather live?
Answer:
The following is provided for general information only. To find out how the law applies to a specific situation, contact an attorney directly. Arizona law does not generally allow a minor child to formally "choose" which parent he or she will live with. That said, the court will often want to hear the child's opinion before making decisions about custody. In fact, it is one of the factors that the court considers before ruling on the issue. This and the other factors considered can be found at ARS 25-403(A)(2).
