- Under these circumstances, it may be best to contact an attorney for help on dealing with the multiple states at issue. Generally, under Arizona law, a court in Arizona has jurisdiction to make an initial child custody determination only if: (1) this state (Arizona) is the home state of the child on the date of the commencement of the proceeding, or (2) was the home state of the child, within six months before the commencement of the proceeding and the child is absent from this state but a parent or person acting as a parent continues to live in this state, see ARS 25-1031. Also, ARS 8-871 deals with establishing a permanent guardianship of a child and ARS 8-872 gives the procedure for permanent guardianship. Also, the link here contains self-help forms for filing for minor guardianship.
