Question: I am currently 17 and 3 almost 4mons.My mother lost us to cps and the case is still open. Can i emancipate myself and get custody of my little brother?
Answer: You may be able to emancipate yourself if you meet certain criteria. If you go to https://www.azcourts.gov/selfservicecenter/Self-Service-Forms/Emancipation-of-a-Minor, you will find an information booklet along with the forms that you need to have filled out and give to the courts. One of the thing you must tell the courts is if you are independent, have a job and are able to support yourself with a place to live, and have healthcare. This may also play into whether or not you are able to care for a sibling. You may want to discuss this with the caseworker or an attorney. They may be able to help you decide what is best for you and your sibling.
