Forms and Letters: Family Law
questions & answers
Question: I would like to do a will. Do I need to hire a lawyer to do it for me?
Answer: In Arizona, you can draft a simple Will on your own. Arizona acknowledges holographic Wills. A holographic Will is one that you write out by hand and sign. It must be in your handwriting, not typed, and signed by you. A.R.S. Section 14-2503. This will suffice if you want a simple Will with few complications. You can also use a "form" Will, but be careful that you carefully fill in the blanks and have two witnesses sign when you sign your Will. A.R.S. 14-2502. However, if you have a lot of assets or if you want a Trust to go with your Will, you will be best served by using a lawyer.
