Divorce & Annulment

questions & answers

Question: Under the Uniform Services Former Spouses Protection Act, the 2017 Rule. If my former wife and I made a verbal agreement to split retirement pay 50/50, will DFAS honor that or would they need a court document stating the amount she would receive?

Answer: An informal agreement will not work.  The government will require a formal document to be on record for division of pension benefits.  They require a proper court order that meets all their criteria.  You and your ex wife may want to consider amending your divorce decree to include a valid order dividing the pension.
