Question: Can I get an anulment instead of a divorce?
Answer: You can certainly 'ask' for one. The controlling statutes are A.R.S. § 25-301 and -302. However, the courts generally grant annulments only in cases where the marriage was void from the start (e.g. bigamy), or voidable (e.g. because one or both of the parties was incompetent to consent to the marital relationship). Put simply, annulment is not an easy fix for parties who simply regret a choice of partners that seemed good at the time, but does not anymore! Again, you can ask. Just do not count on it! But you should definitely consult with a family law attorney with some experience handling annulments. There might facts in your case that do justify such a court order, and I don't want to unfairly discourage you.
