Question: I filed for divorce in Cochise County AZ in May 2011. I moved to Maricopa County the end of May and have drove back to file the other papers, for serving and default. Would it be possible for me to finish the divorce proceeding here in Maricopa? Thank you for your help.

Answer: - Arizona Revised State 12-401(13)  states: “Actions for dissolution of marriage (divorce) or legal separation shall be brought in the county in which a petitioner is residing at the time the action is filed.” However, ARS 12-405  states that “a superior court may, upon written consent of the parties or their attorneys filed in an action, by an order entered on the minutes, transfer the action for trial to the superior court of another county.” There are also other ways to get a change of venue as well, to find out whether a certain action is transferable, it may be best to call the courts and ask. The number to the Cochise County Court is 520-432-4850. The Maricopa County Superior Court number is 602-506-3204. Note - there are certain fees for a change of venue; see this link  for fee prices.
