Child Support

questions & answers

Question: My ex-husband and I divorced in 1992 in KS and had 3 minor children at the time. My ex rarely paid his support and actually owes his children thousands of dollars. The question: the children are adults who have been residents of AZ for many years. They now really need funds and I'm unable to help. How would I initiate an audit of monies owed, and where do I start since none of us have been residents of KS for many years. My ex resides in SC. I have been told there are no time limitations to child support.

Answer: Since this is a Kansas child support decree, you will need to consult with a Kansas attorney who can explain your collection rights under the laws of that State. That attorney may also have practical advice for how to commence your "audit," although Child Support Enforcement authorities normally track that sort of thing. Also, bear in mind that Arizona's rule concerning "no statute of limitations" may not apply to your situation, so you should move quickly.
