Question: When a father is behind on child support by 3 or more months can and will he be arrested and if yes, how long will he stay in jail?
Answer: It is impossible to predict if and when a child support obligor will be arrested for nonpayment. A lot depends on the total amount of arrearage, past efforts to win his cooperation, his current ability to pay, his current whereabouts, and the willingness of local law enforcement (wherever he is) to execute the arrest warrant. A child support warrant will usually set a "purge" amount, which acts as a form of bail. Once he pays that amount, he can be released for further proceedings.
