Child Support

questions & answers

Question: My son has been living with my mother since 2005. His mother has been receiving welfare fraudulently on his behalf and now I owe $7,000.00 in backed child support that was ordered to be paid in 2007. Is there any way the state can make her pay back that money?

Answer:

You may want to review the DES website for child support issues, which includes a list of frequently asked questions. You can also call the DES child support division at 602-252-4045 or 1-800-882-4151. But understand that even if the Mother is successfully prosecuted for fraud, it doesn't necessarily mean that the 2007 judgment will be vacated. There are time deadlines for vacating civil judgments based on fraud or misrepresentation of a party.

You may want to consult with an attorney to find out how the law applies to your specific situation.
