Child Support
questions & answers
Question: I have a question regarding medical insurance. When we were divorced 11 years ago my ex husband was ordered to carry the medical insurance on our son. He was fired from his job about a year ago and found something else that did not have medical insurance so he applied for a "discount" medical card. I have since put our son on my medical insurance to make sure that he has the best coverage. Is there any way to have him pay the premium?
Answer:
You may want to consult with an attorney regarding your situation. Whether or not you can request that the court order him to pay the premiums is really dependent on additional facts (i.e. the language of your divorce decree, more information regarding the "discount medical card," etc.). Also, if appropriate, check as to how child support is impacted by you receiving credit for the monthly health insurance premium costs (for the children only). If there is a 15% difference (plus or minus) see if you and your ex can come to an agreement on the issue. If that is futile, check with an attorney to see if modification of child support is appropriate in your situation or whether there are grounds to seek contribution, reimbursement, etc. for the medical insurance premiums.
