Question: My ex-husband sends the child support payments to me personally and I'd like to have him send through the Clearinghouse... what do I need to do to make this change? He has been paying every month, and the decree does not specify pymt via Clearinghouse. He won't do it voluntarily, so I will need to modify/ the decree. Please note that my ex owns his own business and is therefore self employed. Thanks.

Answer:

Generally, even if your ex-husband is self employed, he will be required by law to obey a wage assignment that is ordered by the court.  If you have an order for child support, but you do not have a wage assignment, you may want to review the following forms about having a wage assignment put into effect.  The forms pertain to matters in Maricopa County.  Review the forms carefully to see if they are applicable to your situation.  If you do not live in Maricopa County, contact your local superior court about its process and requirements.
