Question: I'm currently receiving child support from my ex-husband, however there is back child support that is still owed. I understand I can do a 25% garnishment of his check to surfice the arrears? If so what are the steps?
Answer:
The Maricopa County, Arizona Justice Courts have an informative packet: Introduction to Garnishments. It may help answer your general questions and give you an idea about the overall garnishment process. You should also review the following statutes (pertaining to garnishments):
- ARS § 12-1598 through and including ARS § 12-1598.17
- ARS § 33-1131
Note: the garnishment process involves a lot of paperwork and can get complicated. You may want to speak with an attorney about your situation. Also, check with the court appropriate to your situation as to whether it has different procedures and requirements.
