Question: If my ex-husband is on workers compensation can he get a modification of support amount if he has other accounts such as a retirement, savings etc.?

Answer: He has the right to go to court and request a modification of support pursuant to Arizona Revised Statutes, Section 25-503.  If he does, you will have the right to respond and make counter arguments.  The court looks at the incomes of both parents to determine the support the child needs, then divides that obligation between the parents.  If you look at the child support worksheet on the court's website, you will see that the calculations are based on income.  If he has income from stocks or investments beyond workers compensation, that income is considered.  Assets like retirement funds are generally not considered.  The modification decision will depend on various factors like the length of time he expects to be on workers' comp and the custody arrangements.  The court's website with the self-service center has the child support worksheet and child support guidelines in the family law section.  Go to https://www.azcourts.gov/familylaw.
