Child Support

questions & answers

Question: If I lose rights to my daughter do I still have to pay child support if shes getting adopted by another father. Or do I have to continue the payments even after it's over?

Answer: Losing custody and losing parental rights are two different things.  If your ex has asked the court to terminate your parental rights and allow the stepfather to adopt the child, you have the right to file an objection to the termination and present evidence of your continued efforts to maintain a relationship with the child.  If you fail or object or if you agree to relinquish your rights and allow your child to be adopted by the stepfather, your parental relationship and obligations are at an end.  The adopting father becomes the legal father and takes over the obligation of supporting the child.
