Question: I have a child support agreement from the Maricopa County. My ex wife and son lives in Tucson, AZ I have recently moved to Tucson to be closer to my child. How do I start a child support modification in Tucson when the agreement was settled in Maricopa County?

Answer: You have the right to ask the court for a "change of venue."  Arizona Revised Statutes, Section 12-406 allows parties to request a change of venue when circumstances dictate.  All the Superior courts in Arizona are part of the same court system. Venue represents the county where the action is most appropriate. You would file a simple petition in Maricopa County Superior Court stating that all the parties now live in Pima County and request that venue for the case be transferred to Pima County.  The petition can be very simple.  It will need the case name and case number.  You will need to mail a copy to your ex as per court rules.
