Question: If my child's father currently doesn't have a job or any source of income, am I still able to file child support against hi?

Answer: Yes.  Depending on your individual circumstances, the court may assume an income for your ex.  The court will consider issues like how much your child's father is capable of earning based on education and former job experience.  You may want to consult an attorney before you start the process to get some advice.  There are 3 programs in Arizona that you can use to get some inexpensive legal advice and guidance.  One is the Modest Means Program.  For a $75.00 fee, the Modest Means Program will arrange a one hour consult with an experienced attorney.  The telephone number is (866) 637-5341.
