Child Support

questions & answers

Question: If I'm paying child support and my son has a baby do I still pay child support?

Answer: Your question does not mention your son's age or if he is a legally emancipated minor.  Arizona Revised Statutes, Section 25-501 states, in part:  ". . . every person has the duty to provide all reasonable support for that person's natural and adopted minor, unemancipated  children, regardless of the presence or residence of the child in this state."  It also says: "If a child reaches the age of majority while the child is attending high school or a certified high school equivalency program, support shall continue to be provided while the child is actually attending high school or the equivalency program but only until the child reaches nineteen years of age . . . "

Basically, the statute is saying that Arizona Law requires all parents to support their children until they reach the age of majority (18).  If the child is in high school when he turns 18, support will continue.  If your son is a minor or under 19 and enrolled in school, your support obligation continues.  His being a parent is irrelevant.
