Question: If I live in the same state but different county from my kids and their mom can I file for paternity and to set child support and parenting time in my county?
Answer: You can, but the case may be moved to the county where your ex lives. Arizona Revised Statute, Section 12-401 is the Venue statute which more or less says that people should be sued in he county where they live. If you file in your county, your ex has the right to ask that the case be moved to the county where she lives. In other words, she can ask for a "change of venue" based on Section 12-406.
