Question: We got 2 kids.my son stays with me.and I spend for my sons education and monthly expenses My still want child support for my daughter who stays with her.can she still demand for child support?
Answer: Is there a divorce (dissolution of marriage) decree that states where the children will live and how much child support is to be paid? If your ex went to court and got a child support order at a time when both children were living with her, those circumstances have now changed. Arizona Revised Statute, section 25-503 allows you to go back to the court when circumstances change and ask for a modification of child support. You can find the necessary forms on the website: Superior Court of Arizona.gov. Go to the self-help center and look under family law. Find the appropriate forms, file the papers, and serve your ex as instructed. The self-help center also provides instructions on how to file and serve your papers. You may also want to sit down with a lawyer and get advice on how to move forward. There are 3 programs in Arizona that you can use to get some inexpensive legal advice and guidance. One is the Modest Means Program. For a $75.00 fee, the Modest Means Program will arrange a one hour consult with an experienced attorney. The telephone number is (866) 637-5341. Both the Maricopa County Bar Association and the Pima County Bar Association have lawyer referral services that offer a 30 minute consult with an experienced attorney.
